Legality and security

The rules governing the use of electronic signatures in the European Union are set out in Regulation 910/2014, known as eIDAS - Electronic Identification, Authentication and Trust Services.

The eIDAS Regulation provides a framework and regulates electronic identification services and the trustworthiness of electronic transactions in the European Union. It regulates electronic signatures, electronic transactions and provides a secure way of doing business, for example in the electronic transfer of funds or transactions with public services. The eIDAS Regulation defines standards that grant qualified digital signatures, electronic and time seals the same legal status as their paper-based equivalents. European Union Member States are required to legally recognize eIDAS-compliant electronic signatures.

Depending on the nature of the use, the relevant rules and regulations for electronic signing must also be examined depending on the geographical jurisdiction. In specific cases, national legislation provides for exceptions where the signing of documents is preferred in physical paper form due to associated administrative acts.
